We are the author, publisher, and owner of the internet resource located at https://Jsanalytics360.com and any subdomains thereof, as well as mobile/tablet/console applications and any other electronic modes or technologies ("Platform"). By accessing, viewing, or using the Platform or any of its content, you acknowledge and affirm that these terms of service ("Terms of Service") constitute a legally binding contract, equivalent to a signed written agreement, and you willingly accept these Terms of Service, thereby agreeing to be legally bound by them. If you do not consent to these Terms of Service, kindly refrain from using the Platform and exit promptly.
Furthermore, by either implicitly or explicitly accepting these Terms of Service, you also acknowledge and agree to comply with our policies, including the Privacy Policy, and any additional rules, guidelines, policies, terms, and conditions as required by applicable laws for accessing, browsing, transacting, or availing any services on the Platform ("Services"). Such additional rules, guidelines, policies, terms, and conditions shall be deemed integral to and incorporated within these Terms of Service.
Platform Description and Services
Jsanalytics360 serves as a platform that, among other things, facilitates the provision of various "Services" (as described in Section 1 below, which may also encompass additional services introduced on the Platform in the future). The access and utilization of the Platform by users and visitors ("Users," "you," "your," or "yourself") to avail the Services, which may involve (i) Jsanalytics360 , and/or (ii) third-party diagnostic service providers ("Third-Party Labs"), and/or (iii) third-party medical professionals, healthcare consultants, medical experts, or institutions ("Medical Experts"), are governed by these Terms of Service in conjunction with the privacy policy available at https://Jsanalytics360.com/privacy (collectively referred to as the "Agreement"). The Third-Party Labs and Medical Experts are collectively termed "Third-Party Service Providers."
While Users may freely explore the Platform, registration is required to avail of the Services. By accessing the Platform, registering, or engaging in any form of usage herein, you are considered to have thoroughly read and agreed to the terms outlined in the Agreement, without necessitating any further explicit, implied, or written consent.
Modification and Notification
Jsanalytics360 retains the right to, at any time, either partially or completely, add, amend, modify, cancel, limit, change, or withdraw the Agreement without prior notice. Additionally, Jsanalytics360 reserves the authority to, at its sole discretion and without prior notice, suspend, alter, modify, change, vary, or withdraw the Platform, its features, content, Services, or any part thereof. All alterations or amendments to the Agreement will be made available on the Platform and will become effective as soon as they are published. Your continued use of the Platform after such modifications or changes shall signify your acceptance of the revised or modified Agreement. We encourage you to regularly review these Terms of Service and the Privacy Policy to remain informed about any revisions. If you disagree with the Agreement, kindly discontinue using the Platform immediately.
1. Services
The Services detailed below are facilitated by Jsanalytics360 ("Jsanalytics360") and/or made accessible to Users of the Platform. These Services are subject to the stipulations outlined below, in conjunction with the remaining terms of the Agreement. They are not intended to supersede or diminish the other terms of the Agreement and shall not be construed as derogating from the overall terms herein.
1.1 Private & Secure Health Vault Service
Users have the option to utilize this service to manage their medical cases, appointments, and other medical records. This feature empowers Users to digitally map their medical journey and maintain a comprehensive overview. By availing this Service, Users acknowledge and consent that the Portal may obtain their medical records, including diagnostic reports, lab results, and doctor prescriptions. These records may originate from Third-Party Service Providers and/or be provided directly by the User(s).
The accuracy, completeness, and integrity of the information stored in the Health Vault depend on the information provided by the User or authorized Third-Party Service Providers. It's important to note that the Portal serves as a facilitator for communication and storage of information, without altering the content uploaded to the Health Vault. Jsanalytics360 shall not assume responsibility for any losses or injuries sustained by the User due to actions or omissions based on the information present in the Health Vault.
2. Eligibility
By using the Services provided by Jsanalytics360 ("Jsanalytics360" or "we"), you affirm and guarantee that you:
- Are at least 18 (eighteen) years of age or older, possessing the full ability and competence to comprehend and accept the terms, conditions, commitments, assertions, representations, and warranties outlined in this Agreement.
- Hold the rightful authority, permission, and capability to enter into and fully adhere to all terms and conditions of this Agreement, considering factors such as age, jurisdiction, and the laws of your region.
- Are not misrepresenting yourself as another individual and are utilizing your actual identity.
- Consent to comply with all applicable domestic and international laws, regulations, statutes, and ordinances pertaining to your use of the Platform, including its Services.
3. Term and Termination
This Agreement shall remain in effect as long as you use the Services or remain a User on the Platform. Jsanalytics360 Healthcare Services may terminate your access to the Platform or the Services, either wholly or partially, at its sole discretion and without prior notice, at any given time.
4. Registration, User Profile & Provision of Services
Certain Services accessible on the Platform necessitate a basic registration process to create a User profile. Registering and forming a User profile entails disclosing your identity and/or additional personal details about yourself, which will be subjected to the Platform's Privacy Policy.
Users will be offered the opportunity to register and establish a personal profile on the Platform ("User Profile"), potentially granting them access to various sections of the Platform and additional Services. By participating in the online registration process and forming a User Profile, Users signify their acceptance of this Agreement. Jsanalytics360 Healthcare Services reserves the right, at its sole discretion, to decline registration applications for the creation of a User Profile.
For creating a User Profile, you can:
1. Acknowledge and agree that you may be requested to provide information for the purpose of User Profile verification. This information may include your full name, email address, gender, mobile number(s), date of birth, and current place of residence. Any data you provide should be accurate to the best of your knowledge. We hold no responsibility for incorrect information or omissions on your part.
2. Recognize that safeguarding certain information pertaining to your Platform usage, such as your username, password, email address, contact details, mobile number, and OTP, if applicable, is your responsibility. You are accountable for maintaining password and User Profile confidentiality, and you bear full responsibility for all activities associated with your User Profile.
Upon creating an account, you consent to:
1. Receiving specific communications regarding the Platform or Services, including those from or on behalf of Third-Party Service Providers..
2.Receiving Service-related notifications via SMS, email, or mobile notifications.
Jsanalytics360 Healthcare Services reserves the right to levy subscription and/or membership fees from Users, after providing reasonable prior notice, for any product, service, or other aspect of the Platform in the future. The Services may have certain constraints, such as limits on storage space, subject to the engagement of Third-Party Service Providers with Jsanalytics360 Healthcare Services .
The Platform, its software, or the software application store through which the software is made available for download may feature the capability to automatically search for updates or upgrades to the software. You consent that Jsanalytics360 Healthcare Services , or the relevant software or software application store, may notify you about available upgrades or updates and automatically install them on your device from time to time, unless your device, settings, or computer software prohibits such actions. Installing certain upgrades or updates may be necessary to continue accessing or utilizing the Platform or Services, or specific portions thereof (including upgrades or updates intended to rectify Service-related issues). Any upgrades or updates offered by us shall be considered part of the Services.
Users acknowledge and agree that:
1.Services may be subject to limitations such as disk storage space limits, contingent on the engagement of Third-Party Service Providers with Jsanalytics360 Healthcare Services .
2.Jsanalytics360 Healthcare Services reserves the right to deactivate User accounts in response to inappropriate language, abusive behavior, or misconduct within any functionalities, including reviews, comments, or interactions with stakeholders of Jsanalytics360 Healthcare Services and/or Third-Party Service Providers.
Furthermore, Jsanalytics360 Healthcare Services retains the right to enforce specific limits on the use of the Platform and/or Services or the storage of User Content or Jsanalytics360 Content at its sole discretion without prior notification, while consistently adhering to the Privacy Policy. As a consideration for granting you access to the Platform and Services, you agree that Jsanalytics360 Healthcare Services and its third-party providers and partners may incorporate advertising on the Services or in conjunction with the display of User Content or Jsanalytics360 Content, or information from the Services, regardless of whether the content is submitted by them or others.
5. User Content
When utilizing the Services provided by Jsanalytics360 through its Portal, Users may have the option to upload various types of content, such as existing medical records, reports from Third-Party Service Providers, text, files, images, photos, videos, and other materials. This collection of content, which may also include the ability to provide ratings and feedback for Third Party Service Providers, is collectively referred to as "User Content."
Users and/or Third-Party Service Providers acknowledge that sharing or allowing the sharing of User Content with Jsanalytics360 is undertaken at their own risk. Jsanalytics360 retains the right to store such information for the purpose of delivering Services to Users. Jsanalytics360 reserves the sole and absolute discretion to determine whether User Content is suitable, and it reserves the right to remove any User Content without notice or liability if it is deemed inappropriate. The following is a non-exhaustive list of types of User Content considered inappropriate by Jsanalytics360 :
Content belonging to a third party without proper authorization.
Content that violatesthe intellectual property rights of any party.
Content containing nudity, violence, offensive subject matter, or links to adult websites.
Content featuring objectionable language of a racial, ethnic, or otherwise offensive nature.
Content that is libelous, defamatory, or otherwise harmful.
Content containing viruses, malicious code, or other harmful elements.
Content involving commercial activities without Jsanalytics360 's prior written consent.
User Guidelines
By being granted a license to use the Portal, you agree not to utilize it for any unlawful purpose under applicable laws and/or in violation of these Terms of Use and our Privacy Policy. You commit not to engage in actions that could damage, disable, overload, or disrupt any Jsanalytics360 server, connected network, or interfere with others' use of the Portal. Unauthorized attempts to access functions, features, other User accounts, computer systems, or networks are prohibited, including hacking and other unlawful methods. You shall only access and use information intentionally provided through the Portal.
You are responsible for securing your account information, promptly reporting lost or stolen devices, and notifying Jsanalytics360 of unauthorized account use. Any actions performed from your device are assumed to be initiated by you
You agree not to copy, reproduce, modify, reverse engineer, or create derivative works based on the Portal or its components. You are liable for any activities within your account and must inform Jsanalytics360 promptly of unauthorized account use. You shall not use another person’s account without explicit written permission from the account holder and Jsanalytics360 .
Compliance with applicable laws, rules, and regulations is mandatory while using the Portal's functions and features. You acknowledge and agree to use the Portal at your own risk and that Jsanalytics360 holds no liability for your violations.
7. Intellectual Property
You may not post, modify, distribute, or reproduce copyrighted material, trademarks, or proprietary information without prior written consent from the owner. Jsanalytics360 will take steps to address repeat copyright infringement if identified. If you believe your work is copied on the Portal in violation of copyright, please provide necessary evidence for corrective action.
8. User-Third Party Service Provider Disputes
Users are responsible for interactions with Third Party Service Providers. Jsanalytics360 may monitor disputes but isn't obligated to and may terminate Users' privileges. Jsanalytics360 is not responsible for services' quality, products supplied, or payments due. Claims should be directed to the User or Third Party Service Provider, not Jsanalytics360 .
9. Disclaimer of Warranties
Services are provided "as is" and "as available," and User's use is at their own risk. Jsanalytics360 disclaims any warranties, whether express, implied, or statutory. Jsanalytics360 is not liable for malpractice, negligence, or deficiencies from Third Party Service Providers. Users rely on Services at their own risk, and Jsanalytics360 holds no liability for content provided by Users or Third Party Service Providers.
10. Force Majeure
Neither party is in default if they can't perform obligations due to conditions beyond reasonable control, like acts of God, strikes, or governmental demands.
11. Indemnity
Users agree to indemnify and hold Jsanalytics360 harmless from claims, damages, actions, losses, costs, and expenses arising from use of the Services in violation of this Agreement or third-party rights.
12. Limitation of Liability
Jsanalytics360 isn't liable for direct, indirect, consequential, or other damages, regardless of form of action. Jsanalytics360 's liability is limited to the amount paid for Services. Jsanalytics360 disclaims liability for User Content, Third Party Service Providers, and actions of Users.
13. Information Gathering and Tracked
Users' IP addresses, device details, and other data may be logged. Personal information is subject to the Privacy Policy. Jsanalytics360 may transfer User Content to affiliates within other countries with your consent.
14. Service Levels
Portal aims for at least 99% System Availability yearly. Maintenance may temporarily interrupt Services, with reasonable notice.
15. Waiver and Severability of Terms
Failure to enforce rights doesn't waive them. Invalid provisions don't invalidate entire Agreement.
16. Assignment
Jsanalytics360 may assign its rights and obligations, while User needs written consent for assignment.
